Defending Property Rights
We are a nation established by freedom and democracy, ruled by law, and protected by our Constitution. Yet some political leaders think that the government may take our homes and businesses to benefit more favored private interests; that freedom and security can no longer coexist; that torture and terror are useful tools. We must never sacrifice the constitutional rights and the rule of law that has strengthened our nation and that has inspired peoples throughout the world.
Individual rights and the rule of law have created our strength as a nation and have inspired peoples throughout the world. Yet some political leaders act as if they are above the law. They claim that the government may take our homes and businesses to benefit more favored private interests.
Nels Ackerson has a passion for the rule of law, the Constitution, and individual rights. He is a nationally recognized champion homeowners, farmers, ranchers, small businesses and other landowners, and has devoted his career to defending our Fifth Amendment rights to private property.
Nels has fought for literally hundreds of thousands of property owners against abuses of their property rights by governments and powerful corporations to which governments have delegated the power of eminent domain, such as railroads, power companies and telecommunications companies.
He represented NK Hurst, an Indianapolis company, when its sixty-eight-year-old plant was threatened with condemnation so a parking lot could be built for a new sports stadium for an NFL football team. Nels’ cases have been before state and federal courts first in Indiana, and in 46 states nationwide. He has been lead counsel in state and national landmark decisions that have protected property rights and have recovered property and just compensation from powerful interests that have sought to seize and take land without due process.
Nels has testified before congressional committees and state legislative committees to defend property rights against fraud and abuse. He has written legislation to protect the constitutional and civil rights of Americans.
